AB 149 LOAN MEDIATION IN NEVADA
AB 149 revises provisions governing property foreclosures in Nevada.
AB 149 changes NRS 107 by adding restrictions on the mortgage holder's 'power of sale' with respect to an owner occupied house by giving the homeowner the right to request mediation through which he may receive a loan modification. Once homeowner requests mediation no further action can be taken to sell off the property under foreclosure. Each mediation must be conducted by a senior justice, judge, hearing master or other designee pursuant to rules adopted by the Nevada Supreme Court.
